These terms apply when you install and use Ecto. By installing Ecto on your Shopify store, you agree to these Terms of Service and to our Privacy Policy. Ecto was previously published on the Shopify App Store under the name Casper. This document replaces every earlier terms published for Casper or Ecto.
In these terms, “Outis”, “we”, “us” and “our” refer to OUTIS. “Merchant”, “you” and “your” refer to the business that installs Ecto on a Shopify store. “Customers” are the shoppers who visit and buy from your store.
Ecto (the “App”) is a Shopify app that saves the carts of logged-in customers and keeps them in sync across their devices and browsers. It also lets you view saved carts and their recent history in the App, export carts, and create draft orders from a customer's cart in your Shopify admin.
Ecto works with the cart of customers who are logged in to their customer account on your store. It does not track or sync the carts of anonymous visitors across devices.
We may improve, change or remove features over time. If a change materially reduces the service you pay for, we will tell you in advance through the App or by email.
Ecto is a business tool for Shopify merchants. By installing it, you confirm that you act for business purposes, that you hold a valid Shopify store, and that you have the authority to accept these terms for the business that owns the store. Your use of Shopify itself remains governed by Shopify's own terms.
You can stop using Ecto at any time by uninstalling it from your Shopify admin. Uninstalling cancels your subscription. Charges already billed are not refunded, except where the law requires it or where we decide to issue a refund. Refund requests can be sent to our contact address and are reviewed case by case.
Ecto, its code, design and brand belong to Outis. While your subscription is active, we grant you a personal, non-exclusive, non-transferable right to use the App on the stores where it is installed. Your store data remains yours. You allow us to use it only to provide, secure and improve the App, as described in our Privacy Policy.
We work to keep Ecto available and reliable, but the App is provided “as is” and “as available”. We do not guarantee uninterrupted service. Ecto relies on Shopify and on our hosting provider, and outages on their side can affect the App. Support is provided by email and through the chat inside the App, on business days, in English or French.
Ecto is a tool that helps customers find their cart again. It does not guarantee any level of sales, conversion or revenue.
To the extent permitted by law, Outis is not liable for indirect losses, including lost profits, lost sales, lost data or loss of goodwill, nor for failures caused by Shopify, by your theme, by other apps or by code we do not control.
Our total liability for any claim related to Ecto is limited to the amounts you paid for the App during the twelve (12) months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law, such as liability for fraud or gross negligence.
We may suspend or end your access to Ecto if you seriously breach these terms, if you fail to pay, or if your use puts the App, other merchants or customers at risk. Where possible, we will warn you first. We may also stop offering Ecto altogether, with at least 30 days' notice. When the App is uninstalled or terminated, your data is deleted as described in our Privacy Policy.
We may update this document from time to time. The date at the top shows the latest version. If a change significantly affects your rights, we will let you know at least 15 days before it takes effect. If you keep using Ecto after that date, you accept the new version. If you do not agree, you can uninstall the App.
These terms are governed by French law. Before going to court, we both agree to try to settle any dispute amicably by contacting each other in writing. If no solution is found within 30 days, the dispute will be brought exclusively before the competent courts of Lons-le-Saunier, France, unless mandatory law provides otherwise.
If any clause of these terms is held invalid, the other clauses remain in force. Our failure to enforce a right does not waive it. The English version of this document is the reference version.
For any question about these terms, write to ecto@outis.dev or by post to OUTIS, 109 Rue du Creux, 39570 Messia-sur-Sorne, France.
